Reprieve for families in Ethiopian Airlines crash as renowned US lawyer takes up case

Kenya was the worst hit when Ethiopian Airlines plane Boeing 737 MAX 8 crashed near the town of Bishoftu on 10th March 2019 killing all 157 passengers on board. A total of 32 Kenyans died in that crash, making Kenya the most affected country.

It has been five months since the deadly Ethiopian Airlines crash, affected families have been locked in a legal tussle with US plane manufacturer Boeing for close to half a year now.

Families who lost their kin in the deadly crash can now breathe a sigh of relief as renowned US-based lawyer Manuel von Ribbeck has filed additional lawsuits against Boeing.

For starters, Manuel von Ribbeck is a lawyer who focuses on representing victims of catastrophic incidents, including aviation disasters from human or mechanical errors.

Lion Air

Ribbeck is basically the hope of many aircraft accident victims throughout the world. He also represented families who lost their kin in Indonesian carrier – Lion Air Flight 610, which is the same model with Ethiopian Airlines plane Boeing 737 MAX 8. The October 29th 2018 Lion Air crash killed all 189 passengers and crew on board.

Ribbeck’s law firm – Ribbeck Law Chartered and its co-counsels Global Aviation Law Group and Igeria and Ngugi Advocates filed additional lawsuits against Boeing in the case involving Ethiopian Airlines plane crash.

A total of 66 affected family members are seeking $1 billion/Ksh 100 billion in compensation for damages from the American plane manufacturer.

The renowned lawyer seeks to consolidate the Lion Air and Ethiopian Airlines cases if no settlement is reached soon for his clients. The law firms argue that consolidating the two cases will solve the issue of contradicting orders if the cases are handled by different judges.

City Hall buries 97 unclaimed bodies at Lang’ata Cemetery

City Hall has disposed off more than 90 unclaimed bodies that have been lying at Mbagathi Hospital Mortuary after being given a go ahead by the court.

This comes after Chief Magistrate’s Court at City Hall granted the county government an order to go ahead with the disposal of the bodies which have been lying uncollected at the county hospital’s morgue since April 2018.

MASS GRAVE

The 97 unclaimed bodies, comprising of 56 males and 41 females, have been buried at a mass grave at Lang’ata Cemetery.

“Upon hearing the application for disposal of Ninety Seven unclaimed bodies presented before me by the counsel for the applicant, it is hereby ordered that the application to dispose the attached list of 97 bodies granted as made,” read in part the court order by Chief Magistrate R. Oganyo signed October 16, 2019.

The Application was No.5 of 2019 in the matter of section 169 of the Public Health Act Cap 242 Laws of Kenya. The law recommends that a body should be removed from the mortuary within two weeks and thereafter disposed off.

Prior to that, a 21-day gazette notice should have been done for publication in the dailies with the names of the bodies for ease of identification.

In August, City Hall appealed to Nairobi residents to come forward and identify the bodies which were lying at the morgue.

Then, the suspended Health Executive Mohamed Dagane said the bodies started accumulating at the morgue in 2018 when 70 were booked in and never claimed; another 27 have been booked since the beginning of the year with 12 registered at the facility in the month of April alone.

UNCLAIMED BODIES

City Hall have on several occasions raised concerns over the high number of the bodies lying at mortuaries of its different facilities without any next of kin coming forward to claim them.

In September, the county government raised the alarm over increasing numbers of unclaimed bodies in its health facilities that had hit 273 in number.

City Mortuary, Mbagathi and Mama Lucy Kibaki Hospital mortuaries are some of the most affected hospitals with untaken bodies still lying at the facilities’ morgues with City Mortuary having 172 unclaimed bodies, Mbagathi 97 and Mama Lucy 9.

This prompted the county to advertise for the collection of the unclaimed bodies across the county hospital mortuaries.

At the moment there are 131 unclaimed bodies at the city Mortuary and seven at Mama Lucy Hospital.

The county government is also set to run another advert in the course of the week in order to dispose another set of unclaimed bodies at City Mortuary.

The woman in the meme, is Reality TV star Taylor Armstrong, who was captured on the reality TV show The Real Housewives of Beverly Hills season 2, (Malibu beach from hell) which aired in December 2011.

Taylor is captured having a meltdown with Camille Grammer, as then fellow housewife Kyle Richards attempted to calm her down.

ESTRANGED HUSBAND

The incident happened after her friends claimed that she had lied about having an estranged husband, Russell Armstrong.

Her husband had just committed suicide and Taylor went into a nervous breakdown. Her hospital records, which had been kept private for some time, have proved otherwise after it was discovered she had had a reconstructive eye surgery to correct an injury that she sustained from abuse by Russell.

Responding to the meme circulation, Taylor said on Twitter: “Thank you, that is my past and I have moved on and am in a really healthy happy marriage. It doesn’t seem like my life any longer. I work with domestic violence shelters and support victims. Its (sic) ok to laugh at the images that have been created…”

She later told oprahmag.com: “During the screaming scene, I was truly terrified for my life and my safety. When I look back now, that life seems like someone else’s. I have healed and grown so much stronger since that moment and am in such a happy place with my husband and daughter. I never imagined of all my TV moments, that would be the one to become a ‘meme’ sensation.”

Meanwhile, the cat in the picture is called Smudge who lives in Ottawa with his owner Miranda Stillabower. Smudge has earned a following of 640k on Instagram. lord

He won many hearts through Tumblr in 2018 after Miranda posted him looking unimpressed after a plate of vegetables was placed in front of him.

Since then, the meme has been turned into many things, paintings, cosplay and a Japanese Facebook page even turned it into a video.

Kenyan in US charged with raping another man in prison

A United States court has issued an arrest warrant for a 34-year-old Kenyan who has been accused of sexually assaulting another man while incarcerated.

Clifford Kamau Ibirithi, is accused of sexually assaulting his cellmate and choking the man into unconsciousness while being detained in the ICE (Immigration and Customs Enforcement) section of the York county jail in February of this year.

SEXUAL ASSAULT

The warrant which was issued this week cites several felonies committed by the accused, including sexual assault, strangulation, involuntary deviate sexual intercourse, assault by prisoner and aggravated harassment by prisoner.

According to court records, Ibirithi is also being charged with the second-degree misdemeanor of simple assault.

His alleged victim told investigators that Ibirithi had moved into his cell two days prior to the reported assault, police said, according to York Dispatch.

The cellmate said he woke up to use the bathroom the night of February 21 and felt pressure around his neck and related it was a chokehold, charge documents state.

The cellmate said he lost consciousness shortly after Ibirithi anally penetrated him.

UNCONSCIOUS

The cellmate said he was unconscious for two or three minutes and that when he woke up, he was suffering from rectal pain and was lying on the floor with his pants off.

Ibirithi told police during an interview that the two men had engaged in consensual sexual activity.

Medical records indicated that the victim suffered bruises on his ear, neck, and legs. The report also said the victim suffered multiple lacerations and abrasions in the rectal area.

Tests matched the DNA collected from Ibirithi and the DNA on fluid collected from the victim.

Ibirithi has since been freed from ICE detention and is believed to be living in Tacoma, Washington and has prior convictions for shoplifting and DUI in Delaware.
