Caretaker accused of raping a mentally challenged woman

A 51-year-old man who works as a caretaker was accused in the same court of raping a mentally challenged woman in violation of section 3 of the Sexual Offences Act (SOA) of 2006 at an apartment in Umoja, Nairobi.

Daniel Waka is charged with perpetrating the crime on an unspecified day in March of this year at the building’s rooftop.

Another accusation against Mr. Waka is that on the same date, he performed an indecent act with the woman.

The physically challenged woman, 38, was allegedly approached and sexually assaulted while she was hanging clothes on the rooftop of the apartment building where she lives with her family.

He allegedly threatened to purchase her chapati and warned her not to tell anyone what had happened to her.

She was unable to recall the precise date of the occurrence due to her state.

She was sent to Mama Lucy Kibaki Hospital, where doctors determined that she had been abused after having her examined.

When the police had finished their inquiries, they later detained Mr. Waka.

Before Makadara Law Courts Magistrate Kivuti, he refuted the accusations.

The culprit was released after posting a Sh100,000 bond.

The case will be mentioned on May 11 before the hearing starts on September 27 this year.
