The DPP’s case against Deputy President Rigathi Gachagua and nine other people in the Sh7.3 billion fraud case has been permitted to be dropped by a Nairobi court.
The accused, however, have been warned by the court that, should investigators discover proof, they might be detained again in the future on the same allegations. Gachagua to release him from police custody in exchange for his passport and the Sh12 million he had deposited in court.
The court advises that a statute be passed to create the position of a pre-trial judge, who will determine if there is enough evidence before any accused individual is arraigned in court.
Magistrate Victor Wakumile said: “It is unfair to subject judicial officers to take lengthy notes when there is no case,”
