The theft case against two men was dropped after they maintained their innocence of robbing a customer inside a bar on Kangundo Road in Nairobi’s Njiru Sub-County of a phone and cash.
Bolton Willis Luhombo and Michael Muyanzi Kesekwa were accused of robbing Brian Irungu on August 7 of a cell phone worth Sh28,00, cash worth Sh25,500, and a national identification card.
They denied the accusations before Senior Resident Magistrate Mercy Malingu of the Makadara Law Courts.
The complainant informed the court that he had received compensation for all losses and that he was resigning from the lawsuit.
According to court documents, Mr. Irungu was at the pub having a drink when the two suspects reportedly stole from him while he slept off.
A security officer and a waitress at the pub noticed them and followed them outside as they departed. After almost an hour, they returned to the bar.
The two suspects were detained along with the station guard who was on duty that evening after the complainant brought the incident to their attention. Initially, police believed the two were responsible for a number of violent robberies that had occurred nearby, but further investigation revealed that Mr. Luhombo and Mr. Kesekwa had only stolen from Mr. Irungu, and they were only charged with that offense.
After the complainant indicated that he did not want to pursue charges against the two accused, the criminal procedure code’s Section 87(a) was invoked the case against them
